SAPP raises burning of Sabah flag, Akjan issues

TAWAU: MP Datuk Chua Soon Bui said the new Security Offences Act is not specific especially on the impending threats of terrorism, extremism and organised crime activities that might threaten the security and safety of the public.

She also asked the reason for dangerous arms, weapons or technology that might cause harm to the public not being included in the Act.

In welcoming the repeal of the ISA, Chua asked the Prime Minister whether the Security Offences Act is the only one to replace the ISA because the Prime Minister's pepartment had announced earlier that two new laws would be enacted to replace the ISA.

She said the repeal of the ISA was because it was outdated as Malaysia is no longer facing threats of the communists and some of the clauses under ISA were against human rights especially on the long detention period without trial.

She also referred to special application on "action would be taken if one is to excite disaffection against the Yang di-Pertuan Agorig" whether this application also includes the Sultan or Yang di-Pertua Negeri.

In this respect, she referred to two incidents that happened in Sabah which warrant clarification on the application of the Act.

The first case was the burning of Sabah flags in Lahad Datu on April 2009 with the claim on Sabah as reportd on New Sulu Times and Internet.

“Such claim has been repeated every now and then despite repeated assurance by the government that such claim no longer exists,” she said.

“We cannot take for granted the threats of such anti-malaysia sentiment and elements that still exist in the state of Sabah,” she said.

She wanted to know what actions had been taken against these people who burned the flags and whether such act posed threats to excite disaffection against Yang diPertuan Agong or Yang diPertua Negeri Sabah.

She said it would be dangerous to ignore such anti-Malaysia element in Sabah as it would sent a negative message to these groups that such crime could be accepted in the country.

The second case was a Sabahan who installed himself and proclaimed as the 33rd Sultan of Sulu in Kampung Likas, Kota Kinabalu in February last year.

She sought clarification from the Prime Minister whether such act is an offence against the Yang diPertuan Agong and Yang diPertua Negeri Sabah.

She asked whether these two cases have contravened the Security Offences Act.
